释义 | 律政司司長 The chief administrative and legal officer of the government. Before 1 July 1997, the post of Secretary for Justice was called Attorney General. The Secretary for Justice is appointed by the Central People’s Government upon nomination by the Chief Executive of the Hong Kong SAR, and is the principal legal adviser to the Chief Executive, to the government and to individual government departments and agencies. The decision to prosecute criminal offences is the sole responsibility of the Secretary for Justice who in this respect operates independently, free from any interference. The Secretary of Justice acts as defendant in all civil actions brought against the Government and represents both the Government and the public interest in the courts. As guardian of the public interest in a wider sense, the Secretary for Justice may make application for judicial review to enforce public legal rights. The Secretary has a right to intervene in any case involving a matter of great public interest. The Secretary represents the public interest as counsel to tribunals of inquiry. The Secretary of Justice must be a Chinese Hong Kong SAR citizen according to the Basic Law art 101. 政府主要的行政及法律人員。在1997年7月1日之前,律政師師長的職位稱為律政司。律政司司長由中央人民政府在香港特別行政區的行政長官的提名下委任。律政司司長是行政長官、政府及個別政府部門及機構的主要法律顧問。對刑事罪行作出是否起訴的決定是律政司司長單獨的責任,可免受干擾獨立地行事。在針對政府的所有民事訴訟中,律政司司長會作為被告,及在法院代表政府和公眾的權益。作為廣義的公眾權益監護人,律政司司長可申請司法覆核以強制執行公眾法律權利。律政司司長在任何涉及重大公眾權益的事項上有干預的權利。按照《基本法》第101條,律政司司長必須是香港特別行政區的永久居民。 |
