释义 | 事實裁斷 1. A process by which an international tribunal or court determines the facts of a given case by appointing an impartial third party (‘fact finding commission’ or working party) to present a record of facts in a given dispute. Fact finding does not include making a decision or forming an opinion on legal issues involving in the dispute. In the Western Sahara Case 1975 ICJR 12, the International Court of Justice sent a fact finding mission to find out whether Morocco and Mauritania had any historical ties with the Spanish Sahara. 2. The legislature may through legislation empower a decision-maker with the function of fact finding. Such function should not be usurped by the court and a judge ought to strictly restrict himself to a scrutiny of the decision-making process rather than trespassing on the fact-finding: Bui Van Ao v The Refugee Status Review Board (CACV 179/97, unreported).
