释义 | 事實裁斷者 The person or body having the legal authority to determine questions of fact in judicial proceedings. In a criminal trial on indictment, it is the jury which determines all issues of fact: Criminal Procedure Ordinance (Cap 221) ss 41, 42. If an accused has been convicted after trial by jury, the court should respect the implications which flows from the verdict upon the facts of the case: Kwok YauShing v R [1967] HKLR 664. However, if the factual implications of a verdict are not clear-cut, the judge must step in: R v Cheng Chi Keung [1983] 1 HKC 371 (CA). In summary proceedings it is the magistrate or judge who determines the facts depending upon the constitution of the court: Magistrates Ordinance (Cap 227) s 19; District Court Ordinance (Cap 336) s 79(4). Also known as ‘trier of fact’ or ‘a judge of facts’.
