单词 Accruer clause
An express clause contained in a deed or testamentary gift to named persons, in either equal or designated proportions, which provides that if any beneficiary’s share fails (for example due to a beneficiary predeceasing the testator), that share of the estate will accrue or pass to the remaining named beneficiaries. It has been held that if such an accruer clause does not designate the proportions in which the failed share shall vest in the other beneficiaries, it would accrue to the other beneficiaries in equal shares: Re Bower’s Settlement Trusts [1942] Ch 197. See also Lapse of gift.
另見 Lapse of gift。
