| 释义 | 合租賃狀態的修葺 A state of repair as, having regard to the age, character and locality of the property, would make it reasonably fit for the occupation of a reasonably minded tenant who would be likely to take it: Goldring PW v Humphreys Estate & Finance Co Ltd (1909) 4 HKLR 1118. It is a standard of repair for a tenant which amounts to taking care of the leased property on a day to day basis having regard to the length of the lease: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.306]. It is synonymous with good repair and habitable repair: Fujitsu Hong Kong Ltd v Kwan Sit Chan [1991] HKDCLR 23. Accordingly the tenant must do such repairs as are necessary to preserve the premises and to make them suitable for a new tenant: Anstruther-Gough-Calthorpe v McOscar [1924] 1 KB 716 (CA). The duty of a weekly tenant is to use the premises in a husband-like manner: Warren v Keen [1954] 1 QB 15.
