A series of limitations or restrictions imposed on purchasers, including subsequent purchasers, of land that has been subdivided. In Hong Kong, a building scheme is a common species of this genus: Lee Hysan Estate Co Ltd v Sky Heart Ltd [1997] 1 HKC 313; Sky Heart Ltd v Lee Hysan Estate Co Ltd [1999] 1 HKC 18, 1 HKLRD 100. The requirements to be satisfiedfor a scheme of development are that: there was a common vendor under whom the various owners derive title (Conveyancing and Property Ordinance (Cap 219) s 41(7)); before the land was sold, there was a scheme relating to a defined area which the vendor intended to sell in lots, containing restrictions which were to be imposed on all the lots and which, though varying in details as to particular lots, were consistent only with some general development; the restrictions were intended by the vendor to be and were for the benefit of all lots sold; and both parties purchased the property knowing the restrictions were to ensure for the benefit of the other lots: Elliston v Reacher [1908] 2 Ch 374.
