| 释义 | 按比例運費 A method of calculating freight by reference to the extent to which the contract of carriage has been completed. Pro rata freight may be paid as a proportion of the agreed freight when the goods are delivered at a port short of the agreed port of discharge with the consent of the cargo owner. Pro rata freight is payable for short delivery at the agreed destination: Ritchie v Atkinson (1808) 10 East 295. However, the cargo owner can counterclaim for short delivery not caused by excepted perils: Amoco Oil Co v Parpada Shipping Co Ltd, The George S [1898] 1 Lloyd’s Rep 369. Pro rata freight is payable for delivery short of destination only if the cargo owner has expressly or impliedly agreed to pay pro rata freight: Cutter v Powell (1795) 6 Term Rep 320; Appleby v Myers (1867) LR 2 CP 651.
