An interest (usually legal or equitable) in something, the peril of which would by its proximate effect cause damage to the owner (the insured), that is to say cause him or her to lose a benefit or incur a liability: Halsbury’s Laws of Hong Kong, Vol 5, Insurance [220.614]. Generally, an insured must have an insurable interest in the subject matter of the insurance because the legislation prohibit insurance by way of gaming or wagering: Marine Insurance Ordinance (Cap 329) s 4(1); Insurance Companies Ordinance (Cap 41) s 64B(1). Examples of insurable interests include a person’s interest in a marine adventure (Marine Insurance Ordinance (Cap 329) s 5(1)); in his or her own life; the interest of a parent of a minor or a guardian of a ward under 18 years of age in the life of the minor or the ward (Insurance Companies Ordinance (Cap 41) s 64A(2)). To constitute an insurable interest in property, the insured must have some legal or equitable interest in the property insured at the time of the loss. Under the indemnity principle, an insured can only be compensated for the loss suffered by him or her. See also Insurance.
