释义 | 保險合約 A contract of speculation in which the insurer agrees, consideration of money (a premium) paid to the insurer by the assured, to indemnify the latter against loss resulting from the happening of a specific event: Prudential Insurance Co v IRC[1904] 2 KB 658. The facts upon which the risks are to be computed lie mostly within the knowledge of the assured only. The concept of uberrimae fidei (utmost good faith) forbids either party concealing private knowledge of a fact to draw the other into a bargain entered into through ignorance of the fact and belief to the contrary: Joel v Law Union & Crown Insurance Co [1908] 2 KB 863 (CA); Lai Chui Kar Poa Helen v American International Assurance Co (Bermuda) Ltd [1985] 2 HKC 689 (HC).
