A term of delimitation indicating the extent of an employer’s vicarious liability. An employer is liable for the wrongful acts or for the wrongful modes of doing authorised acts undertaken by an authorised employee: Poland v John Parr & Sons [1927] 1 KB 236 (CA). If the act is one which, if lawful, would have fallen within the scope of the employee’s employment, the employer must accept responsibility inasmuch as the employer authorised the employee to do that particular class of act and is therefore precluded from denying the employee’s authority to do the act complained of: Lloyd v Grace, Smith & Co [1912] AC 716 (HL). If, on the other hand, the act is one which, even if lawful, would not have fallen within the scope of the employee’s employment, the employer is not bound: Iqbal v London Transport Executive (1973) 16 KIR 329 (CA). An employer is liable for his employee’ act if there is sufficiently close connection between the task engaged in and the tort committed: Tse Ngan Heung v Ritz Carlton Ltd [2002] 1 HKC 146.
