释义 | 積極性契諾 A covenant to expend money, or do something or which is otherwise positive in nature: Conveyancing and Property Ordinance (Cap 219) s 41(6). At common law, the burden of a positive covenant does not run with the land: Austerberry v Oldham Corp (1885) 29 Ch D 750 (CA). In Hong Kong, the traditional equitable doctrine has been extended by allowing the enforcement of positive covenants: Conveyancing and Property Ordinance (Cap 219) s 41(2). This is necessary in respect of covenants in a deed of mutual covenant affecting common ownership of a multi-storey building: Wong Kam Lan v Well Win Investment Ltd [1996] 2 HKC 143. However, an occupier will not be liable to the covenantee or his successors in title for breach of a positive covenant merely because he is an occupier at the material time. There has to be something more than occupation to make him liable, such as a covenant contained in his lease. It is not enough that there is a covenant in a Deed of Mutual Covenant binding on the lessor: Discovery Bay Services Management Ltd v David Buxhaum [1995] HKDCLR 7.
