| 释义 | 無抵押債權人 A person who has lent money to a debtor without holding a mortgage, charge, or lien on the property of the debtor or any part thereof, as a security for a debt. If the borrower refuses or is unable to repay the unsecured loan, the unsecured creditor must undergo a much more protracted legal process to recover the funds than a secured creditor, if he can recover at all. On the question of winding up a company whose assets are entirely covered by debentures, the wishes of the unsecured creditors must be regarded in preference to those of the secured creditors: Re Crigglestone Coal Co Ltd [1906] 2 Ch 327 (CA). However, the judgment creditor should not be given an advantage over other unsecured creditors by the granting of a charging order absolute which would effectively convert him into a secured creditor, and in such a case the charging order nisi should be discharged: Roberts Petroleum Ltd v Bernard Kenny Ltd (in liq) [1983] 2 AC 192, 1 All ER 564 (HL).
