释义 | 產假 Any absence from work by a female employee because of her pregnancy or confinement; ‘confinement’ means the delivery of a child: Employment Ordinance (Cap 57) ss 2(1), 12-15C. A female employee employed under a continuous contract immediately before taking any statutory maternity leave is entitled to statutory maternity leave: s 12(1). Failure to grant leave is an offence: s 15A(1). Maternity leave is granted as an aggregate of (1) a continuous period of ten weeks from and inclusive of the statutory date of commencement of maternity leave or the actual date of confinement if earlier (ss 12(2)(a), 12AA); (2) a further period equal to the number of days, if any, beginning on the day after the expected date of confinement up to and including the actual date of confinement, which must be taken immediately following the ten week period (s 12(2)(b)); and (3) a further period, not exceeding four weeks, on grounds of illness or disability arising out of the pregnancy or confinement (s 12(2)(c)). Maternity leave is granted in addition to annual leave: s 12(11).
