| 释义 | 僱員 A person who works under a contract of employment (or contract of services) with an employer. The fundamental test to determine whether a person is an employee or not is this: ‘Is the person who has engaged himself to perform these services performing them as a person in business on his own account?’: Market Investigations Ltd v Minister of Social Security [1968] 3 All ER 732, [1969] 2 QB 173. Any person who has entered into or works under (or, in the case of a contract which has been terminated, worked under) a contract with an employer, whether the contract is by way of manual, labour, clerical work or otherwise, is express or implied, oral or in writing, and whether it is a contract of service or apprenticeship or a contract personally to execute any work or labour: Labour Relations Ordinance (Cap 55) s 2; Trades Union Ordinance (Cap 332) s 2. It includes a former employee and any person who wishes to take up employment as an employee after attending a retaining course or a supplementary retaining programme: Employees’ Retraining Ordinance (Cap 423) s 2. ‘Employee’ means a person to whom the Employment Ordinance applies: Employment Ordinance (Cap 57) ss 2(1), 4.
