释义 | 受損/損傷 1. Anatomical loss or loss of bodily or intellectual functioning. 2. A changing for the worse, diminishing in value or deterioration from a previous unimpaired or less impaired state. Impairment also includes a condition that impairs a person’s thought processes, perception of reality, emotions or judgment, or that results in disturbed behaviour; or reliance on remedial devices such as a guide dog or wheelchair. Impairment of a person’s physical or mental condition is within the meaning of ‘personal injury’: Law Amendment and Reform (Consolidation) Ordinance (Cap 23) s 22(3); High Court Ordinance (Cap 4) ss 43(3), 48. Damages should not be based on the plaintiff’s degree of impairment of whole person as suggested by the medical experts: Chan Wai Tong & Anor v Li Ping Sum [1985] HKLR 176.
