释义 | 大律師免責權 Protection or immunity from all forms of civil liability afforded by common law to barristers on public policy grounds in respect of their conduct of proceedings in court: Rondel v Worsley [1969] 1 AC 191 (HL). A barrister is immune from an action for negligence at the suit of a client in respect of his conduct and management of a cause in court and the preliminary work connected therewith such as the drawing of pleadings: Saif Ali v Sydney Mitchell & Co (A Firm) & Ors [1979] 3 All ER 1033, [1980] AC 198 (HL). Such immunity is based on public policy in that the administration of justice requires that a barrister should be able to carry out his duty to the court fearlessly and independently and actions for negligence against barristers would make the retrying of the original actions inevitable and prolong litigation contrary to public interest: Rondel v Worsley, supra. The same immunity applies equally to solicitors acting as advocates: Mackay v Ford (1860) 5 H & N 792.
