| 释义 | 免涉訴訟 In coronial law, a coroner’s judicial immunity from legal proceedings. A coroner has immunity from legal proceedings in respect of acts or omissions done by him in the honest belief that the act or omission was required or authorised in the discharge or purported discharge of any of his duties, or in the exercise or purported exercise of any of his powers: Coroners Ordinance (Cap 504) s 48(1). The protection extends to any person assisting a coroner in the discharge or exercise or purported discharge or exercise of any of the coroner’s duties or powers: s 48(2). Consequently a police officer assisting a coroner in an inquiry will have protection: Police Force Ordinance (Cap 232) s 10(ga). See also Coroner. 指死因裁判官就法律訴訟程序享有司法免責權。死因裁判官在法律訴訟程序中，如真誠地相信其作為或不作為，是他在履行或其意是履行他的責任時或在行使或其意是行使他的權力時，所須作出或獲授權作出者，享有免責權：《死因裁判官條例》（第504章）第48(1)條。免責權的保障擴展至協助死因裁判官履行或其意是履行死因裁判官的責任或行使或其意是行使死因裁判官的權力的人：第48(2)條。因此在調查中協助死因裁判官的警務人員亦可得到保障：《警隊條例》（第232章）第10(ga)條。另見死因裁判官。 |
