释义 | 不道德合約 A contract which is made upon a sexually immoral consideration or for a sexually immoral purpose, is against public policy and is illegal or unenforceable: The Ki Hing Lau v The Shun Loong Lee Firm [1910] HKLR 83. Although such a contract does not necessarily, nor even usually, involve criminality, it is no different in civil consequences to commit a crime: Pearce v Brooks (1866) LR 1 Exch 213. Given the great deal of change in sexual morality in recent years, it is difficult to ascertain to what extent a modern court would follow earlier authorities concerning immoral contracts, and therefore, the law concerning immoral contracts is uncertain.
