| 释义 | 宣告裁決 The communication of a jury’s finding at the conclusion of a case. In a criminal trial the jury’s verdict will be their decision on the guilt of the accused. In a civil case tried with a jury the verdict will concern their finding in favour of one or the other party. The verdict must be delivered in open court: Jury Ordinance (Cap 3) s 26. It is delivered by the foreman and recorded by the registrar or clerk of the court: s 26. However, the verdict may be delivered at an earlier stage in two circumstances: (1) where the accused has changed his plea from not guilty to guilty while in the charge of the jury, in such case the jury may return a verdict of guilty; (2) where after the close of the prosecution case the jury indicates that they wish to acquit the accused without hearing more: Halsbury’s Laws of Hong Kong, Vol 9, Criminal Law and Procedure [130.814].
