释义 | 惡意檢控 Bringing a criminal action which is motivated by ill will or evil intent rather than to serve the interests of justice. An abuse of the process of the court by wrongfully setting the law in motion on a criminal charge: Mohamed Amin v Jogendra Kumar Bannerjee [1947] AC 322 (PC); Everett v Ribbands [1952] 2 QB 198, 1 All ER 823 (CA). To be actionable as a tort the process must have been without reasonable and probable cause, must have been instituted or carried on maliciously and must have terminated in the plaintiff’s favour: Mohamed Amin v Jogendra Kumar Bannerjee, supra. The plaintiff must also prove damage: Quatrz Hill Consolidated Gold Mining Co v Eyre (1833) 11 QBD 674 (CA). Analogy could be drawn with the tort of malicious prosecution that there must be some element in the defendant’s conduct apart from to serve the interests of justice: The Maule [1995] 2 HKC 769 (CA). If no adequate justification for the proceedings is put forward then malicious intent may be implied.
