1. A method or system of secret voting. The method may be undertaken by placing small balls (or ‘ballots’) in a box. The fairness of a system of decision-making involving an element of balloting must be considered as a matter of balancing the interests of the individual applicant against the interests of the public: Pearl Securities Ltd v Stock Exchange of Hong Kong Ltd [1999] 1 HKC 448. The method of secret ballot is adopted in elections for public offices in order to guard the franchise against intimidation, riots, duress, bribery and undue influence, with the end aimed at being a free election of a representative by a majority of those entitled to vote. Secrecy is provided to guard the freedom of election: Kean v Kerby (1920) 27 CLR 449. 2. A method of random determination between candidates in an election: Eyre v Milton Proprietary Ltd [1936] Ch 244 (CA); and Hot Holdings Pty Ltd v Creasy (1996) 134 ALR 469.
