It is a requirement of a valid marriage that the parties be a man and a woman: Marriage Reform Ordinance (Cap 178) s 4. This is because the definition of marriage is in terms of the voluntary union of one man and one woman: s 4. The determination of whether a person is a man or a woman for the purpose of this definition should first be carried out by chromosomal, gonadal and genital tests.
