| 释义 | 知會備忘 Lat – let them beware. A notice to the effect that no action may be taken unless the person who gave the notice was informed. Real property - A warning. The main function of a caveat is protective, but not to give notice. It is simply a claim by someone that he shall receive notice before any dealings with land is carried through: J & H Just (Holdings) Pty Ltd v Bank of NSW (1971) 125 CLR 546, [1972] ALR 323. An equitable interest in land capable of sustaining a caveat can arise under a conditional contract before specific performance could be ordered of the contract: Ji Shan International Ltd v Resources Main Enterprises Ltd [1998] 1 HKLRD 800. Succession - A written notice or warning placed on probate application documents filed in the Probate Registry which, while it remains in force (usually six months), prevents the applicant from obtaining the grant of probate, administration or resealing until after a warning has been served on the caveator and the caveat shall cease to have effect or upon the determination of a probate action by the court: Non-Contentious Probate Rules (Cap 10A) rr 44(4), (7)-(11), (12). Until the caveat expires or is withdrawn or removed by order of the court, a grant of representation cannot be made: r 44(6). A caveat can be lodged at any time prior to probate being granted by any person having a relevant interest in the deceased estate.
