释义 | 防範原則 The principle, applied in relation to performance of a building contract, that time is at large and the proprietor’s right to liquidated damages is lost if, due to any act of prevention of the employer, the contractor fails to complete the works by the date of practical completion. Acts of prevention which would render time at large include the employer’s failure to give possession of the site, or to provide plans at the proper time, or by interfering improperly in the carrying out of the works, or by ordering extras which necessarily delay in giving essential instructions, etc. The prevention principle applies unless the contractor has agreed to complete by the due date notwithstanding the proprietor’s act or omission: Amalgamated Building Contractors Ltd v Waltham Holy Cross UDC [1952] 2 All ER 452; Wells v Army & Navy Co-operative Society (1902) HBC (4th Ed) Vol 2 p 346; Dodd v Churton [1897] 1 QB 562.
