Termination of one’s involvement in an offence, before the offence is committed. A person who withdraws from a crime is not criminally liable for the criminal conduct of another. To escape liability the person must expressly and clearly countermand the crime or withdraw from it at an early stage (R v Croft [1944] KB 295, 2 All ER 483 (CCA)), including taking reasonable steps to undo the effect of previous encouragement or participation. Mere repentance or withdrawal is insufficient: R v Fletcher [1962] Crim LR 551 (CCA). The person’s actions should amount to unequivocally and timely communicating to the other party his withdrawal or countermand and revocation of the counselling or procuring previously given or undertaken: R v Rook [1993] 2 All ER 955, 97 Cr App Rep 327 (CA); HKSAR v Chan Ho Kay (CACC 375/99, unreported).
