| 释义 | 押記令 An order by a court restraining dealings with the shares or property of an individual or a company made under the High Court Ordinance (Cap 4) s 20 or the District Court Ordinance (Cap 336) s 52A. Although a charging order over shares or land is not within the concept of a registrable charge against a company, upon liquidation, a creditor shall be treated as having completed the execution or attachment and be entitled to retain the benefit against the liquidator on the making of the charging order: Re Overseas Aviation Engineering (GB) Ltd [1963] Ch 24; Companies Ordinance (Cap 32) ss 80, 269. As for charging order on land, the beneficial interest of a purchaser of land under an agreement would not be affected by a charging order registered in the Land Registry subsequent to the agreement: Tse Fook Choy, Joey Callan v Kwong On Bank Ltd [1999] 3 HKC 126, 1 HKLRD C13.
