In ascertaining whether a gift is a charitable gift, regard must be had to not only the nature of the gift itself but also the character and objects of the charity who are intended recipients of the gift and to whether the activities of the supposed charity are of a public nature: Re Mariette, Mariette v Aldenham School Governing Body [1915] 2 Ch 284.
