释义 | 竊聽 The use of electronic or mechanical equipment to gain access to transmissions or private telephone conversations, computer data, or facsimiles, sent to someone else. Surveillance, whether electronic or otherwise, interceptions of telephonic, telegraphic and other forms of communications, wire-tapping and recording of conversations are prohibited: Human Rights Committee (HRC) General Comment No 16 (32nd session, 1988). Tapping and other forms of interception of telephone conversations represent a serious interference with private life and correspondence and must accordingly be based on a ‘law’ that is particularly precise. It is essential to have clear, detailed rules on the subject, especially as the technology available for use is continually becoming more sophisticated: Malone v United Kingdom (1984) 7 EHRR 14.
