释义 | 證人干擾 The act of deterring, threatening, intimidating, or molesting a witness, or inducing a witness not to give evidence before a court or a tribunal. Any interference with a witness to a pending or imminent suit, the purpose or effect of which is to deter the witness from giving evidence or to influence the nature of the evidence given, is a serious interference with the administration of justice and a contempt of court. The interference may take any of a number of forms: keeping a witness out of the way, by bribery or otherwise, so as to avoid or prevent service of a subpoena (Lewis v James (1887) 3 TLR 527); assaulting, threatening or intimidating a witness or a person likely to be called as a witness (Re B (JA) (an infant) [1965] Ch 1112, 2 All ER 168); arresting a witness on the way to, or while attending, the court to give evidence (Magnay v Burt (1843) 5 QB 381); endeavouring to influence a witness against a party by, for instance, disparagement of the party (Welby v Still (1892) 66 LT 523); endeavouring by bribery to induce a witness to suppress evidence (Re Hooley, Rucker’s Case (1898) 79 LT 306), or dissuading a witness from giving evidence (R v Toney (1993) 97 Cr App Rep 176 (CA)). A court may order an accused person to be admitted to bail subject to a condition that he shall not interfere with a witness: Criminal Procedure Ordinance (Cap 221) s 9D(2)(c). It is an offence to tamper with, deter, threaten, molest or in any way unduly influence any witness in regard to any evidence to be given by him before the Legislative Council or a committee, or to threaten, molest or in any way punish or injure or attempt to punish or injure any person for having given evidence before the Council or a committee or on account of any evidence which he has given before the Council or a committee: Legislative Council (Powers and Privileges) Ordinance (Cap 382) s 19 (c), (d). It is also an offence to interfere by threats, or persuasion or otherwise induce a witness or a party not to give evidence in any hearing before the tribunal: Labour Tribunal Ordinance (Cap 25) s 41(1).
