| 释义 | 證人保護 A programme designed to protect the personal safety and wellbeing of witnesses where their safety is at risk on account of the witness having given evidence or agreed to do so in proceedings before a declared authority: Witness Protection Ordinance (Cap 564) s 2. It is also designed to protect any other person associated with such witnesses. In Hong Kong, the programme is governed by the Witness Protection Ordinance (Cap 564). The approving authority, as appointed by the Commissioner of Police and the Commissioner of the Independent Commission Against Corruption, has the sole responsibility in deciding as to whether a witness should be included in the programme: Witness Protection Ordinance (Cap 564) s 4. The approving authority shall take such action as he considers necessary and reasonable to protect the witness’ safety and welfare: s 7. Subject to the approval of the Chief Executive, witnesses included in the programme are given new identities, and have the right not to disclose their original identities: ss 8, 10. The approving authority may also restore the witness’ original identity (s 12) or terminate the protection given under the programme (s 11). The disclosure of information by either the approving authority and the participants in the programme are governed strictly by the Ordinance: s 18.
