释义 | 子女的意願 Any preferences expressed by a child in relation to an application for a parenting order in relation to the child. In relation to the custody or upbringing of a minor, and in relation to the administration of any property belonging to or held in trust for a minor or the application of the income of that property, in any proceedings before any court (whether or not it is the Court of First Instance or the District Court), the court must give due consideration to the wishes of the minor if, having regard to the age and understanding of the minor and to the circumstances of the case, it is practicable to do so: Guardianship of Minors Ordinance (Cap 13) s 3(1)(a)(i). However, the weight that a court might attach to a child’s wishes is discretionary and depends on what is appropriate in the circumstances of the case. Generally, the court will not make an order for custody against the wishes of a minor who is or above 16 years old: Stark v Stark [1910] P 190.
