| 释义 | 非婚生子女 A child born to unmarried parents and whom the Legitimacy Ordinance (Cap 184) has not been subsequently legitimated nor recognised as legitimate under any law: Marriage Ordinance (Cap 181) sch III. When considering whether a child is illegitimate, the court will have regard to the law of domicile of the parents at the time of birth: Re Sit Woo Tung [1990] 2 HKLR 410 (HC). Where an Ordinance or a document requires that the relationship between two persons to be construed, the relationship shall be construed without regard to the person’s illegitimacy: Parent and Child Ordinance (Cap 429) s 3(1). It is included in the definition of ‘child’ in various Ordinances: Companies Ordinance (Cap 32), Family Status Discrimination Ordinance (Cap 527), Disability Discrimination Ordinance (Cap 487), Widows and Orphans Pension Ordinance (Cap 94), Pension Benefits (Judicial Officers) Ordinance (Cap 401), Surviving Spouses’ and Children’s Pensions Ordinance (Cap 79), Pension Benefits Ordinance (Cap 99), Sex Discrimination Ordinance (Cap 480), Estate Duty Ordinance (Cap 111), Auxiliary Forces Pay and Allowances Ordinance (Cap 254), and Matrimonial Proceedings and Property Ordinance (Cap 192).
