| 释义 | 違法合約 A contract which the court refuses to enforce because it involves the commission of a legal wrong (ie an act which is prohibited by legislation or which amounts to a civil wrong under the common law) or because it is contrary to public policy: Skilton v Sullivan (The Times, 25 March 1994) (CA). A contract may be void and not illegal (as in restraint of trade cases), or be both illegal and void (as in an immoral contract), or be merely unenforceable. The court will not enforce a contract which is expressly or impliedly prohibited by statute: St John Shipping Corp v Joseph Rank Ltd [1956] 3 All ER 683, [1957] 1 QB 267; The Ki Hing Lau v The Shun Loong Lee Firm [1910] HKLR 83. A party to an illegality could recover the legal or equitable property interest if he could establish his title without relying on his own illegality: Best Sheen Development Ltd v Official Receiver and Trustee [2001] 3 HKC 79 (CFI).
