| 释义 | 誹謗性質的事宜 An imputation concerning any person, or any member of his or her family, whether living or dead, by which the reputation of the person is likely to be injured. This includes any injury the person is likely to sustain in his or her profession or trade, or any imputation by which other persons are likely to be induced to shun, avoid, ridicule, or despise the person. At trial, the judge has to decide whether the words complained of are reasonably capable of bearing a defamatory meaning and it would be left to the jury to be decided as a question of fact: Slim v Daily Telegraph Ltd [1968] 1 All ER 497, 2 QB 157 (CA); Oriental Daily Publisher Ltd v Next Magazine Publishing Ltd (CA) [1999] 2 HKC 678 (CA).
