An easement created or reserved in favour of a grantee or grantor without formality by way of implication, and it would appear that easements will be implied more readily in favour of the grantee than a grantor: Sihombing & Wilkinson A Student’s Guide to Hong Kong Conveyancing (1997) ch 12, p 697. The principle of such easement is that on the grant by the owner of a tenement or part of a tenement as is then used and enjoyed, there will pass to the grantee all those continuous and apparent easements which are necessary to the reasonable enjoyment of the property granted, and which have been and are at the time of the grant used by the owner of the entirety for the benefit of the part granted: Wheeldon v Burrows (1879) 12 Ch D 31; Tai Hang Wen Albert v Progressive Group Ltd [1999] 4 HKC 232. Such grant can only be implied where both the dominant and servient tenements have been in common ownership so that the creation of an easement by implication of law may be said to be the outcome of the former relationship between the two tenements: Halsbury’s Laws of Hong Kong (2001 Reissue) Vol 16, Land [230.0539].
