| 释义 | 未經註冊的船舶 Any ship which is registrable, but has not been registered, under the Merchant Shipping (Registration) Ordinance (Cap 415). Notwithstanding that a ship is registrable, the Director of Marine may direct the Registrar of Ships not to register the ship if he is satisfied that it would be inappropriate for the ship to be registered, having regard (a) to the condition of the ship so far as relevant to its safety or to any risk of pollution; or (b) to the safety, health and welfare of persons employed or engaged in any capacity on board the ship: Merchant Shipping (Registration) Ordinance (Cap 415) s 22(3). An unregistered ship is prohibited from leaving Hong Kong waters. No mortgage can be registered against an unregistered ship. A ship that is not registered with any jurisdiction is not entitled to enjoy the benefits, privileges, advantages or protection offered by the flag state. A stateless ship will not be protected under international law and is liable for seizure: Naim Molvan v A-G for Palestine [1948] AC 351.
