释义	合約前承諾 Promises on which a party claims to have relied in deciding to make a contract that did not in fact become terms of the contract. A party can claim on damages for a pre-contractual promise which induced him into entering the contract if the promise or statement was made fraudulently: Peek v Derry (1887) 37 Ch D 541. Where a person has entered into a contract after a misrepresentation has been made to him otherwise than fraudulently, and he would be entitled, by reason of the misrepresentation, to rescind the contract and claim damages: Misrepresentation Ordinance (Cap 284) s 3(2), (3).
