释义	委任權 In disposition of property under a will or trust instrument, a power granted by the testator or settlor to a specified person, the appointor, to select or appoint a beneficiary or beneficiaries from a general or specific class to take an interest in some property, real or personal, of the deceased estate or the trust. For example, Y is given a power of appointment where testator X leaves property to Y for life, with power to decide who should get the property on Y’s death. The power of appointment in selecting the beneficiaries or objects of the power may be general (appoint anyone including the appointor), special (appoint only from a specified class) or hybrid (appoint anyone except specified persons) and involves an exercise of discretion by the appointor in relation to distribution. A power to appoint among a class with a gift over in default of that appointment is a ‘bare power’. A power coupled with an obligation to execute that power is a ‘trust power’: Re Gulbenkian [1968] Ch 126; Re Hay’s Settlement Trusts [1981] 3 All ER 786, [1982] 1 WLR 202.
