释义 | 解除可流通票據 Complete extinguishment of all rights and liabilities on a negotiable instrument, terminating its life and negotiability. Distinguished from discharge of a party, discharge of the instrument extinguishes the instrument itself, rendering it a mere piece of paper of evidentiary value only. A negotiable instrument may be discharged by payment in due course (Bills of Exchange Ordinance (Cap 19) s 59(1)); when the acceptor of a bill is or becomes the holder of it at or after its maturity, in his own right (s 61); when the holder of a bill at or after its maturity absolutely and unconditionally renounces his rights against the acceptor (s 62(1)) or when a bill is intentionally cancelled by the holder or his agent, and the cancellation is apparent thereon (s 63(1)). The rules of common law apply to the discharge of negotiable instruments unless they are inconsistent with the express provisions of the Bill of Exchange Ordinance: s 102(2). An accord and satisfaction made between the holder and the principal debtor discharges the instrument.
