The relieving of juror from their responsibilities after the case starts. The judge has the discretionary power to discharge the jury or a juror. However, this discretionary power could be exercised only when there is a high degree of need but might not be based on the interest of justice: Winsor v R (1866) LR 1 QB 289; Jury Ordinance (Cap 3) s 25(1). The order of discharge should be made in open court and in presence of the accused: R v Richardson [1913] 1 KB 395, 29 TLR 228. The judge in a trial, prior to verdicts, may discharge the jury or juror(s) under the following circumstances: if the jury hear inadmissible evidence or material prejudicial to an accused (R v Wong Chung Ling [1995] 2 HKCLR 179, 3 HKC 82 (HC)); if a juror demonstrates bias or misconduct himself; if the circumstances make continuing the trial impractical, such as the illness of the accused, a major witness or a juror (R v Hornsey [1990] Crim LR 731 (CA)); or if there is an attempt to influence jury or jurors (R v Spencer, R v Smails [1987] AC 128, [1986] All ER 928 (HL)).
