释义	分配機制 A system of assigning the risk and cost of loss to particular persons, employed by courts and legislatures, in decisions concerning the sources of compensation to a plaintiff. Rather than merely shifting the loss from the victim to the tortfeasor, such a scheme recognises that many wrongdoers do not have the financial resources to recompense their victims, and that some activities, although dangerous, are beneficial to a larger section of the public. Also known as ‘loss spreading’ or ‘loss distribution’. See also Compensation. 法庭及立法機關在決定給予原告人的賠償的金錢來源時所使用的機制，使風險及損失成本轉與某特定人士。該機制承認很多犯事人沒有財政能力再補償受害人，及某些活動雖然危險，但對大部份公眾人士屬有益，而非僅將損失從受害人轉到侵權人身上。另稱「損失分散」或「損失分佈」。另見 Compensation。
