释义 | 向合約局外人賦予利益 To form a contract which contains a provision that intended to benefit a person who is not a party to it. The fact that a contract attempts to confer a benefit on a stranger to the contract does not invalidate the contract. The stranger cannot enforce under the contract but the contract remains valid as between the parties there to: Betty Ho, Hong Kong Contract Law (1994) p 312. The third party is entitled to keep the benefit if there was truly a promise to pay him and the original intention was to benefit him, if the promisor performs, whether voluntarily or under legal compulsion: Beswick v Beswick [1968] AC 58. Under the doctrine of privity of contract, the stranger has no right to sue on the contract: Beswick v Beswick, supra.
