Facts and knowledge that are not in the public domain: Coco v AN Clark (Engineers) Ltd (1969) 86 RPC 41. Confidential communication passing between a client and his legal adviser and made for the purpose of obtaining or giving legal advice, are, in general, privileged from disclosure. The privilege is available in respect of the oral testimony of witnesses, and the principles which determine whether a communication is or is not privilege are the same for both oral and written communications. The privilege is that of the client and may be waived by the client. Confidential communications other than those passing between a client and his legal adviser are not privilege from disclosure: Halsbury’s Laws of Hong Kong, Vol 12, Evidence [175.214]. Confidential communications between a client and his legal adviser are not privileged if made for the purpose of committing a fraud or crime, or, a fortiori, when both are engaged in the commission of some wrongful act: Russell v Jackson (1851) 9 Hare 387.
