The area of law concerned with the relationship between the employer and the individual employee. It differs from industrial law. Employment law regulates the formation, performance and termination of a contract of employment as the basis of the employment relationship. Although much of the modern law of employment is contained in statutes and subsidiary legislation, the legal basis of employment remains the contractual relationship between the employer and the employee: Halsbury’s Laws of Hong Kong, Vol 10(2), Employment [145.001]. The principal items of legislation governing employment and employment protection in Hong Kong are: the Employment Ordinance (Cap 57); the Employees’ Compensation Ordinance (Cap 282); the Contracts for Employment Outside Hong Kong Ordinance (Cap 78); the Labour Relations Ordinance (Cap 55); the Labour Tribunal Ordinance (Cap 25); the Minor Employment Claims Adjudication Board Ordinance (Cap 453); the Occupational Retirement Schemes Ordinance (Cap 426); the Mandatory Provident Fund Schemes Ordinance (No 80 of 1995) (not in force); the Sex Discrimination Ordinance (No 67 of 1995) (not generally in force); the Disability Discrimination Ordinance (No 86 of 1995) (not generally in force); the Protection of Wages on Insolvency Ordinance (Cap 380); and the Trade Unions Ordinance (Cap 332).
