释义 | 寬恕 The act of pardoning or overlooking. Employment - In relation to employment, the act of an employer condoning or forgiving an employee’s breach, the employer loses any right to dismiss the employee summarily on the grounds of the breach: Ho Wing Cheong (t/a Hong Leong Securities) v Graham Margot [1991] 1 HKLR 245; Wyldbore v Bayubay [1987] 2 HKC 304. See also Summary dismissal. Family law - Formerly, forgiveness by one spouse of another with full knowledge of all that has been done. The wrongdoer was restored to the position that he or she held before the event: Spilstead v Spilstead (1944) 44 SR 242, 61 WN 150. However, adultery and cruelty shall not be deemed to have been condoned by reason only of a continuation or resumption of cohabitation between the parties for one period not exceeding three months, or of anything done during such cohabitation, if it is proved that cohabitation has continued or resumed, as the case may be, with a view to effecting a reconciliation: Separation and Maintenance Orders Ordinance (Cap 16) s 6A.
