This is significant in terms of assessing the point at which risk of loss of the cargo passes from the consignor or charterer to the carrier. There may not necessarily be actual contact between the two vessels but such contact suggests there should be close contiguity: Palgrave Brown & Son Ltd v Owners of SS Turid [1922] 1 AC 397 (HL).
