Criminal law - A person who drives or attempts to drive or is in charge of a motor vehicle on any road while he is under the influence of drink or drugs to such an extent as to be incapable of having proper control of the motor vehicle commit an offence: Road Traffic Ordinance (Cap 374) s 39. An intoxicated passenger who suffers injuries as a result of entering a vehicle driven by a drunk driver may be found to be contributorily negligent in the event of a collision: Owens v Brimmell [1976] 3 All ER 765, [1977] QB 859. A drunken person cannot expect a higher standard of care from his neighbours than a sober person or plead intoxication as justification for not taking the same standard of care for himself as he would have if he was sober: M’Cormick v Caledonian Ry (1903) 5 F 362. The higher the level, the greater the risk the offender posed to the other road users: HKSAR v Ho Ho Chuen [1998] 2 HKC 544.
