| 释义 | 藉違約解除 The discharge of a contract as a result of a party breaching an essential term, condition or repudiating the contract, an innocent party to a contract is entitled to regard itself as discharged from performance of its obligations under the contract. The party so discharged often exercises the right that he is entitled: Summit Link Ltd v Sunlink Group (Hong Kong) Co Ltd (HCMP 2439/98, unreported). The breach can be an anticipatory one: Brain Future Ltd v Century Crown Ltd (HCMP 813/98, unreported).
