释义 | 不合理解僱 The termination of a contract of employment without valid reason. A dismissal is deemed to be unreasonable if the court or the Labour Tribunal finds that the employer has not shown a valid reason as specified and the employer is deemed to intend to extinguish or reduce any right, benefit or protection conferred or to be conferred upon the employee by the Employment Ordinance: Employment Ordinance (Cap 57) ss 32K, 32M(1). In determining whether or not an employer has shown that he has a valid reason, the court or the Labour Tribunal shall take into consideration the circumstances of the claim: s 32L; Vincent v South China Morning Post Publishers Ltd [2003] 4 HKC 119 (CA). A dismissal need not be wrongful to be unfair. Unfair dismissal may be prohibited by a contract of employment, by legislation, or by an award.
