释义 | 空氣地役權 An easement for the flow of air from a servient tenement to a dominant tenement along a defined channel or through a defined aperture. A general flow of air over land is not sufficiently definite to be classified as an easement. The rules for creation of easements for air are substantially the same as those applying to easements for light. The right to a flow of air can subsist as an easement if it is claimed in respect of some definite channel, such as a ventilator in a building: Cable v Bryant [1908] 1 Ch 259, but not if what is claimed is that the current of air flowing indiscriminately over the entire servient tenement shall not be interrupted: Webb v Bird (1862) 13 CBNS 841, 143 ER 332; Bryant v Lefever (1879) 4 CPD 172 (CA).
